On August 12, 2022, APD patrol officers arrived at Earnest Jones's house and found M.G. lying on the ground in the front driveway suffering from gunshot wounds. There was a shotgun on the ground close to M.G. Officers also found several spent .223 caliber casings and two spent shotgun shells in the front yard area of the residence. Officers also encountered Jones, who had a small wound to his collar bone area. Jones was subsequently interviewed.
During the interview, Jones said he woke up during the night and saw someone around his carport. When Jones went outside, M.G. pointed a gun at him. Jones went back inside and then went into his backyard. Jones said M.G. shot at him while he was in the backyard, and he was hit in the collar bone area. Jones initially didn't say he shot M.G. APD investigators advised Jones of his rights and Jones then said he fired at M.G. with his "AR." Jones said he put the AR rifle in the trunk of the red car at his house. Investigators recovered an Anderson Manufacturing, Model AM-15, .223 caliber rifle, bearing serial number 21357958 from a red or maroon Mercury Grand Marquis in the backyard of Jones's house.
Jones was treated at the hospital for his injury. Medical staff removed one shotgun pellet from his left collar bone area. Jones's medical information documented marijuana use on August 12, 2022.
