Ernesto Drew Pena OAG Report
On Monday, April 25th, 2022, officers made a traffic stop in the 1200 block of N Hill Amarillo TX 79107, on black 2003 Honda Accord bearing TX tags LYB1300. Officers made contact with the driver of the vehicle who was later positively identified as Ernesto Drew Pena. Officers upon contact had Ernesto turn off the vehicle which he did. During the stop, Ernesto was asked to exit the vehicle and the driver's door was opened by an officer. Ernesto did not comply and started the vehicle. Officers gave him commands to not do this. Ernesto put the vehicle in drive and an officer was able to put his foot on the brake and was at this point on top of Ernesto. Ernesto had his foot on the gas pedal as the engine was revving very loudly. While the officer was on top of Ernesto trying to get Ernesto from fleeing, Ernesto was able to pull out a black semi-automatic handgun with his right hand. The officer began trying to control Ernesto's hand that had the gun and was telling the officer behind him that Ernesto had a gun. The second officer discharged his weapon striking Ernesto in the left temple. Officers did not render first aid as it was obvious that Ernesto was deceased.
